If there is no will and the estate is worth less than $75,000 (not including the homestead and certain non-probate assets), the estate may qualify for this procedure. The small estate affidavit can be used in limited situation to obtain small assets of an estate.

The cost of obtaining a small estate affidavit is often much less than a full suit to determine heirs. Though many some estate affidavits fail because heirs cannot agree and/or are unavailable to be found, the cost is generally much less expensive than an heirship proceeding. The small estate affidavit can only be used in limited situations and often requires an attorney to assist with obtaining the signed order admitting the small estate affidavit.
